Validity of the terms and conditions and conclusion of contract

 

These general terms and conditions (GTC) apply to sales contracts with private customers and companies that are concluded on the Magic EVA website in the online shop.
 The order is confirmed by Magic EVA. The contract is concluded as soon as the confirmation arrives at the buyer. If the confirmation is not received within 14 days, the buyer regards this as a rejection of the order and is entitled to conclude the contract with another supplier.
 For sales contracts that are in a different way, e.g. These general terms and conditions also apply by telephone, email, fax or letter. Customers are informed in the order confirmation where they can view and download the terms and conditions on the Internet. If a customer does not agree to the terms and conditions in such cases, he can withdraw from the purchase.

 

Prices and price changes

 

The prices are given in CHF. VAT and handling fees are included. Shipping costs will be charged separately if the products are not offered as free shipping.
 Magic EVA reserves the right to change prices at any time. For customers, the prices published on the website on the order date apply.

 

Terms of delivery and withdrawal

 

Deliveries are usually made in Switzerland within 2-5 working days, in other European countries 5-7 and overseas within 5-22 working days. If a longer delivery period is necessary, the customer will be informed at the latest after this time. If no information is given, the customer is entitled to waive the delivery. Deliveries within Switzerland and to Lichtenstein will not be charged shipping costs.
 If a customer withdraws from the purchase due to late delivery or defects in the goods or other reasons for which Magic EVA is responsible, he will be refunded amounts already paid. The customer has a right of return. If the customer returns the purchased goods in perfect condition and in the original packaging within 21 days, we will refund the full purchase amount. The cost of return shipping is at the expense of the customer.

 

Liability and guarantee

 

Magic EVA guarantees for a period of 2 years that the goods have the guaranteed properties, that they have no defects that impair their value or suitability for the intended use, and that they comply with the prescribed services and specifications.
 The buyer must check the delivered goods as soon as possible and report defects immediately. The responsible customer service can be found at magiceva.ch. Secret defects can still be objected to after commissioning or use of the goods. This does not apply to manipulated products. These are checked by our in-house technical service.
 If there is a defect, the buyer has the right to receive a replacement delivery.

Liability for online connections

 

Magic EVA undertakes to provide security according to the current technical status in systems, programs etc. that belong to it and over which Magic EVA has influence and to follow the rules of data protection.
 Customers have to ensure the security of the systems, programs and data that are within their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.
 Magic EVA is not liable for defects and malfunctions for which the company is not responsible, especially not for security defects and operational failures of third-party companies with which Magic EVA works or on which Magic EVA is dependent.
Furthermore, Magic EVA is not liable for force majeure, improper handling and disregard of risks on the part of the customer or third parties, excessive use, unsuitable operating resources of the customer or third parties, extreme environmental influences, customer interventions or malfunctions by third parties that occur despite the necessary current safety measures.

 

Legal application and place of jurisdiction

 

The court at the domicile or domicile of one of the parties is responsible for legal actions brought by a customer. Magic EVA has jurisdiction over the court at the defendant's domicile.
